Germany: Crucial Changes Expected in EU Merger Control

There are changes of EU Merger Control Rules to be expected in 2021 which could have significant impact on EU merger control practice, i.e. (1.) referrals, (2.) simplifications in cases which do not raise substantive concerns and (3.) the substantive assessment of cases of the digital economy.

On July 22, 2020 the European Commission published its notice with guidance for national courts on how to protect business secrets in antitrust damages court proceedings: (1.) redacting of confidential information, (2.) confidentiality rings and (3.) appointment of experts.
